DULUTH, Ga. — The Faith & Freedom Coalition Executive Director Timothy Head issued the following statement ahead of oral arguments for the Supreme Court case Dobbs v. Jackson Women’s Health Organization:
“Fifty years ago, the Supreme Court unconstitutionally ruled to establish the right for women to obtain an abortion essentially throughout their entire pregnancy with Roe v. Wade. Nineteen years later, Planned Parenthood of Southeastern Pennsylvania v. Casey ‘affirmed’ the Roe ruling, and yet it also made way for a wholly different framework for determining the constitutionality of state abortion laws.
“Now, through Dobbs v. Jackson Women’s Health Organization, the court has the opportunity to right these past wrongs and protect the lives of millions of preborn children by overturning Roe and Casey. While some argue the decisions should be upheld because of the principle of stare decisis, that principle is meant to be applied to constitutional rulings. That would exclude Roe and Casey; the authority belongs to the states.
“We’ve seen the Supreme Court overturn egregious laws in decisions like Loving v. Virginia and Brown v. Board of Education, and now it’s time for Roe v. Wade to follow suit. The Faith & Freedom Coalition hopes that the court will not only recognize the moral atrocity that the Roe decision was, but we hope they will also acknowledge the unacceptable roadmap it is for state legislators as they navigate creating abortion laws.”
The Supreme Court is set to hear oral arguments for Dobbs v. Jackson Women’s Health Organization on the morning of December 1. The case originated in 2018 when Jackson Women’s Health Organization, a Mississippi abortion clinic, challenged in federal court that the Gestational Age Act was unconstitutional. The Supreme Court case will address the issue of whether all restrictions on abortions before the point of viability are unconstitutional.
